PATRICK WISCOMBE:  It’s the Utah Real Estate Podcast.  My name is Patrick Wiscombe.  Coming up today on today’s edition of the Utah Real Estate Podcast, we are going to talk about using a short sale on your house as a strategy to get out of your house.  It’s kind of an interesting topic.   I don’t know, I think most people think of short sales as this horrible thing, but you can actually use it as a tool to get out of your house. Joining me for the Podcast, as he does when we decide to record, when his schedule avails himself; Ned Chidester, one of the owners of Weichert Realtors at the Rockies, a Real Estate agent here at Weichert Realtors at the Rockies.  How are you?

NED CHIDESTER:   I’m doing great!

PATRICK:  If someone comes to you and says, “I need to get out of my house because I just simply cannot pay for it anymore,” whether it’s loss of a job, or reduced income, whatever the situation is, you actually talk about short sale as being a strategy.  Why is that?

NED:  It really can be a strategy if you’re in a situation where you owe more on your home than you can sell it for.  If you’re in a bind, you have a reason to sell it.  Whether you can’t afford to make the payments anymore, maybe you’ve been transferred with your job, maybe you’ve gone through a divorce, and maybe there are health issues.  Whatever the case may be, there are answers, and there’s a reason that you would use an opportunity to do a short sale, as opposed just allowing the home go to foreclosure, and ruining your credit.  

PATRICK:  Ok, let’s talk, let’s go short sale 101.  What is a short sale?  

NED:  A short sale is when you owe more on your house than you can sell it for in today’s market.  

PATRICK:  So, someone who is “under water”. 

NED:  Somebody who is “under water”, and we negotiate “short” with the bank.

PATRICK:  Ok, now would that include a first mortgage, and a second mortgage?  Or, is it just the primary mortgage?  

NED:  Any mortgages that are attached to the title.

PATRICK:  Ok, alright.  What’s the next step in this process? 

NED:   The next step would be to contact us, and let us take a look at it.  Let’s see what your home is worth, what is comparable, take a look at your history with your mortgage company, make contact with them, tell them that you have an interest in selling, and that it’s going to be short.  The very first step would be to contact us, and let us take a look at it and get the ball rolling for you.  Not only do you not want to do it on your own, but there’s no reason to do it on your own.</itunes:summary>

Ned Chidester, one of the owners at Weichert Realtors at the Rockies, Real Estate agent, all around good dude joins me for the Podcast. Hello!

NED CHIDESTER:  How you doin’ brother!

PATRICK:   Yesterday we talked about home prices starting to stabilize, and we’re kind of on this kick of 5 reasons why you should sell your house now if you’re even considering it.  Yesterday I mentioned we’re talking about how home prices are starting to stabilize. But another part of those bullet points to this conversation is getting ahead of the competition.  What does that mean?

NED:  According to the Utah Association of Realtors, absorption rates, which are the number of homes that are on the market versus the number of homes that are selling, have improved by almost 33%.

PATRICK:  Wow!

NED:  We’re down to about a 5, a little over a 5 month supply.  So this means there are fewer homes for sale on the market, creating a greater demand.  Historically in our marketplace, spring time is typically when homes come on the market.  So the idea of getting ahead of your competition is the stats are proving that homes are selling.  We have a shorter supply on the market, but the market is going to increase as far as number of homes as we get deeper into spring.  As you’re well aware, if you don’t like the weather in Utah, wait a day.  That’s been the case this spring.  But I think as the weather turns, and we warm up, there’s going to be more homes.  So the idea would be to get your home on the market if you’re at all thinking about it and beat out the competition.

PATRICK:  There’s a stigma out there in the market place. We might as well just talk about it for a minute, that Real Estate agents really don’t do a lot; and that was before I started doing Real Estate.   I can now, genuinely say that was kind of the stigma I had as well.  Being on this side of the fence now, I could not disagree more.  But, it also depends on the person.

How are you?

NED CHIDESTER:  Good, good Patrick how are you?

PATRICK:  Good.  Let’s talk about some of the reasons why people should genuinely try and sell their house right now.

NED:  The first thing that comes to my mind is home prices are stabilizing, and I would say for the last couple of years we’ve been in a situation where the market has been declining.  We’ve seen home prices falling.  What we’re starting to see now, the new trend is that prices are starting to stabilize.  In fact, in some markets right here in UT, home prices are starting to increase and go the other direction.  So we’re starting to see prices go up which is a good sign that we’re headed towards a more healthy market.

PATRICK:  Because of all the bad home economic news, or property economic news, I would say that the general perception still, as of today April 18, 2013, is that the housing market is really depressed; that that’s just simply not the case.

NED:   Well you’re exactly right!  In fact, if anything, what we’re seeing is we have many more people who want to buy houses right now; which would be another reason why it’s a good time to sell, but we have a lot more people who are showing interest in purchasing homes; either their first home or investors or what have you, than we have homes to sell.  So we’re starting to see that trend, which is also forcing prices to a stabilized level, or moving towards increasing.

PATRICK:  Why now?  Is it post-election?

NED:  I think it’s probably a little bit of that.  I also believe that we had, at one point, a lot of inventory on the market, and we’re starting to see a decline in that inventory.  We’re down as much as 40% from this time last year, as far as the number of homes on the market.  So with limited inventory but an increase….you know whether it’s interest rates, whether it’s post-election, whether its people are just ready to buy as opposed to rent, I don’t know what that is. But we’re low on inventory, which is another reason.

PATRICK: Let’s talk about For Sale By Owner.  Why should people NOT want to sell their own house?

NED:  You know Patrick, that’s an interesting topic.  I’m glad you brought that up this morning.   We have a belief system with our organization, as you know that if you don’t need a Real Estate agent to sell your house, that’s awesome!  I mean we really do have a belief system that that is great.  We want to be remembered as people that are here to help, and we’re here to help you achieve your goals.  If you don’t need a Real Estate agent, and you can sell your house on your own, that’s great!  You’ve saved the money!  We are firm believers and supporters of that.  However, if the time does come that you need a Real Estate agent, whether it be for the time, for marketing, for negotiating; whatever the case may be, we want to be remembered as a company that didn’t bug you.  It’s that we were here to help, and not to be a disturbance, or to merely cost you more time, and more money.   

PATRICK:  Let me put it this way. We are not; let me emphasize that, NOT the company that says, “We’re not happy ‘till you’re not happy!” 

NED:   That’s exactly right.  And you know to back that up even further, we are the only Real Estate Company, as you know, that is Gephardt approved.  Bill Gephardt came in here and really went through our company’s books, went through our history with the Better Business Bureau, went through our policies and procedures; and we were able to earn that distinction, and to this day we are the only Real Estate Company that is Gephardt approved. 

PATRICK:   Let me get back to For Sale By Owner. I know one of the procedures we have internally, when we call For Sale By Owner owner’s, is to ask them what their goal is.

NED:   Absolutely!

PATRICK:  And we can say, “How much are you trying to net on the house?” “What is your end goal?”  “Other than selling your house, how much money do you want to walk away with?” And obviously,</itunes:summary>

Patrick Wiscombe:  Its the Utah Real Estate podcast. Good morning, my name is Patrick Wiscombe.  Coming up on today&#039;s edition of the Utah Real Estate podcast, yesterday we were talking about quality of life.  I chuckled at the beginning of yesterday&#039;s show that quality of life generally refers to health, and I guess there could be health related issues if you move into a bad area.  But we were actually talking about some factors if you&#039;re looking to buy a house in a particular neighborhood.  We also talked about the sex offender registry, something that most people don&#039;t even think about.  We talked about interviewing some of the neighbors to make sure they&#039;re people you actually want to live around.  You can also determine if there are any noisy neighbors or gang activity or suspicious night-time visits.  In case you&#039;re wondering why we&#039;re chuckling, just listen to yesterday&#039;s podcast.  Coming up on today&#039;s edition of the show, we&#039;re going to be talking about some additional factors you should consider if you&#039;re looking to buy a house in a particular neighborhood.  Are there lots of rental homes?  We&#039;re going to talk about that right now.  Joining me for the podcast is Ned Chidester, one of the owners at Weichert Realtors at the Rockies.  Hey there.

Ned Chidester:  How&#039;s it going, sir?

Patrick Wiscombe:  Good.  Let&#039;s talk about some of those quality of life issues.

Ned Chidester:  One of the things I&#039;ve noticed a lot lately is drug activity.  It&#039;s amazing.  I had a property located in a quiet area that you wouldn&#039;t have expected any issues.  They buyers, during the contract period, conducted a test for meth which came back positive and it got me thinking where we are as a society that there is the use, and in this case, the manufacturing of illegal drugs in our community and I believe some of the situations can be harmful and if there is suspected use, it&#039;s very important to have a test done.  

Patrick Wiscombe:  Is there a way people can find out what kind of activity has taken place in a neighborhood?  The police department?  Are there any particular resources where people can get the unvarnished truth about a neighborhood?

Ned Chidester:  You know, that is a great question.  The police department is one area, one place you can start.  The police department can tell you if they have been called out to an address and can tell you about any suspicious activity in the neighborhood.</itunes:summary>

Coming up on today’s edition of the Utah Real Estate Podcast we’re going to be talking about home inspections and why they are required.  Joining me for the podcast is Greg Hales, the Commercial Real Estate Manager at Weichert realtors at the Rockies.  Good morning.

Greg Hales:  Good morning.  

Patrick Wiscombe:  Yesterday we talked about appraisals and why appraisals are so important to the whole process; essential really.  Why does someone have to get a home inspection when buying or selling a piece of real estate?  

Greg Hales:  I don’t think you can disclose too much when you are selling a piece of property.  We live in a litigious society.  We want to make sure when we buy or sell something that everybody knows exactly what we are buying.  If I were to sell you something, I want you to know everything about it.  That’s basically what a home inspection is.  It allows the buyer to know everything about the home that you know.  For all of your listeners out there, I want to pass on a little bit of advice.  Don’t be afraid to disclose the warts on your house.  Everybody needs to make an informed decision.  You don’t want to sell something and have someone have a letter from the law firm in your box thirty days after you sell the house because they didn’t know about it.  Please take the time, expose it, and discuss it.  This reminds me of a home we sold.  We had a dishwasher line break and it flooded a lot of the upstairs and part of the downstairs.  We go to sell it and on the inspection sheet it asks if we had any floods.  The answer would be no, but in the box below I filled out, “Dishwasher line broke, caused water damage.”  The inspector came back and said, “Whoa, this thing has had water damage!”  Don’t be afraid to let those details come out.  Subsequently we did sell the house because we were up front with them.  

Patrick Wiscombe:  So just be completely honest?

Greg Hales:  Yes.  The other thing that everybody gets nervous about on a home inspection is if they find something, they’re going to ask you to fix it.  Mostly it is up to 500 dollars that you might be required to fix that thing in the house.   At that point in time it’s up for negotiation. Greg Hales:  Good morning, how are you this morning?

Patrick Wiscombe:  Doing alright.  Now I mentioned at the beginning of the podcast that there are three things that every piece of property needs to go through; the appraisal, the title report, and the home inspection.  Let’s begin with the appraisal.  Why is an appraisal necessary?

Greg Hales:  Well I think the appraisal is now becoming the top of everybody’s list.  With so many short sales and modified sales in your neighborhood, sometimes you’re not going to get the appraisal you think.  I want to tell all of your listeners out there to forget about what someone is selling their home for.  That doesn’t have any bearing on an appraisal.  You can go up and down the street and say I know the Jones’ are trying to sell for this or the Smiths’ are trying to sell for this, that doesn’t count.  The only thing in an appraisal that would help your appraiser is what a home sold for.  It’s the only thing of value that they can base it on and they will only use that in their report.  Now, an appraisal will take in a number of things.  It will take in your square footage, the size of your lot, the age, the condition, number of bedrooms, bathrooms, garages, RV pads, etc.  Then they will get a property that is similar to your property and then make adjustments, either pluses or minuses.  So many times people will say, “I know the Smiths’ sold for this.”  If you know that, then it’s not public knowledge.  You need to let your appraiser know that.  The ability to create a value based on a professional opinion, which is what an appraiser does, is only available through what sales are or what a home sold for.  

Patrick Wiscombe:  So the documented proof basically?  

Greg Hales:  Absolutely!  California and a number of other states, I don’t know for sure right now, they use what they call a non-disclosure state.  You don’t have to disclose what your home sells for.  California uses it because that changes their tax base every time a home sells.</itunes:summary>

Greg Hales:  Good morning Patrick, how are you?

Patrick Wiscombe:  Good, let’s get right into this.  Some of the things that people need to do in order to get their house sold; we are developing a checklist of items that people need to do in order to further the sale of their house and one of the things that people absolutely need to do is assist in scheduling all closing details.  Now, what are the closing details and what kinds of things need to be scheduled?

Greg Hales:  As you sell your property, there is really a checklist as you go through them.  You’ll have certain contingencies or things that have to occur before your house can close.  Some of those would include an appraisal, property disclosure, financing deadlines, title report.  Those are sort of the details that continue to keep your contract in place or not.  If I could just take a minute, a word that a lot of people may be familiar with or not familiar with, or as they say, this is contingent upon.  As you see that word or if it’s contingent upon those things, that becomes a checklist item for you and your realtor to take care of and that would include home inspections, appraisals, financing contingencies.  These are the things that your realtor really has to stay on top of so the contract stays in full force in effect.  

Patrick Wiscombe:  And if those things aren’t done, you could have a breach of contract correct?  

Greg Hales:  You could.  You could have a seller’s breach of contract which most guys really don’t think about, or you could have a buyer’s breach of contract.  Either one of those could trigger a breach of contract, so essentially you’re really not selling your home because it’s not under contract.  

Patrick Wiscombe:  Alright, and that’s obviously no place that anyone wants to be.  Now, we also talk about delivering the executed documents to the party that’s involved.  Why is that?

Greg Hales: Good morning Patrick, how was your holiday?

Patrick Wiscombe: My 4th of July was terrific! We went and saw the Beach Boys at Stadium of Fire.

Greg Hales: Fantastic! I’m sure that was as good as it always is.

Patrick Wiscombe: I can’t say that I’m a fan. I will say that I really enjoyed the show. I didn’t realize how many Beach Boys songs I knew.

Greg Hales: That does date you a little bit but it’s still a great concert.

Patrick Wiscombe: Alright let’s get into this. Let’s go over the seller’s checklist so to speak. These are the tools that your real estate agent should be doing for you. Let’s start with calling past customers who may be interested in your home. Now assuming that you’ve had customers come into your home, why would you want to do that?

Greg Hales: Well I think particularly with an experienced real estate agent, they are always on the lookout for a home that might fit a previous customer, somebody that may have had contact with previously, and the timing might not have been good in the past but might be more in the future now.

Patrick Wiscombe: Alright, so basically hold an open house so people can come see your home and then keep some kind of a contact sheet that you can follow up on.

Greg Hales: Yes, that’s exactly right. An effective agent is always prospecting. They know that because a home purchase is such a limited purchase, it’s not something you buy every week or every month.  They know that timing and the timing in the individuals’ lives might be different or their needs might be different so they are always in contact with those who either they have worked with or have done work for in the past, to assess their needs, and possibly fit your home in those needs.

Patrick Wiscombe. Coming up on today’s edition of the Utah Real Estate podcast, yesterday and for the past day or two, we’ve talked about safety.  We’ve talked about are you really prepared to sell your house on your own. Today, we have a ‘did you know’ section to the show. This is something new we haven’t done yet. Joining me for the podcast is Greg Hales, the Commercial Real Estate Manager at Weichert Realtors at the Rockies in the American Fork. Hi there.

Greg Hales:  Good morning Patrick, how are you?

Patrick Wiscombe:  I’m doing well. Let’s get into this. I’m going to throw out some stats and you back it up with your all-knowing wisdom if you would.

Greg Hales:  The all-encompassing crystal ball.

Patrick Wiscombe:  Yes, here we go. Did you know the median selling price with a real estate agent is 16% higher than when homes are sold directly by the owner? Did you know that? If you really break that down, with the commission and with the real estate agents expertise that’s a potential 5 – 9% net gain after commission when selling through a realtor. Most people probably didn’t know that their house will sell for more when the use a realtor. Why is that?

Greg Hales:  You know that has always been a confusing concept in my mind of if you really think you’re going to sell it for more money on your own then using a professional, why would that be?  If I’m looking for a deal, when I go to a garage sale or a flea market rather than Nordstrom’s or one of the department stores, why would I go someplace as a for sale by owner and pay more for it because I think the guy that’s selling on his lawn is not a professional.  He’s not an expert so I think I can take advantage of him, as a buyer, I can get it for less.  So sellers need to understand that your purpose in selling your home is sell it for the highest price available for the highest net back to you.  When you consider that it is 15-16% higher, minus out a 6-7% commission, well on a 100,000 dollar home an additional 5% is 5,000 dollars.  Believe me, I know places I can put an extra 5,000 dollars.  

Patrick Wiscombe:  It’s also a fact that owners will accept less if you try and sell your house on your own.

Coming up on today’s edition of the Utah Real Estate Podcast; you’ve seen the signs in the yard, for sale by owner.  You’ve tried to perhaps buy a piece of property on your own and I realize that we are in the realty business.  Most people think, “Ah I can do it on my own!”  But are you really prepared to sell your house on your own?  Joining me for the podcast this morning is Greg Hales, the Commercial Real Estate Manager at Weichert Realtors at the Rockies in American Fork, good morning.

Greg Hales:  Good morning Patrick.  How are you again this morning?

Patrick Wiscombe:  I’m doing well.  Let’s get into this particular topic.  Are people really prepared to sell a piece of property on their own but why are some of the reasons why people should not consider selling their house on their own?

Greg Hales:  There’s one question that every home owner wants to know, what is my home worth?  Well, they’ll call the Jones’ down the street or the Smiths’; they’ll look up on a realtor, what are you asking for their home, what are you listing your home for?  That is not a good indicator of what your home is worth.  Your home is worth what a willing buyer will buy your home for and a willing seller will sell your home for.  Now, Utah is a non-disclosure state.  I don’t want to use too many terms you are unfamiliar with, but non-disclosure means when you record your deed or your sale, you are not required to disclose it publicly.  California is a disclosure state such as they use that for the tax basis.  It’s a very good system but not to get bogged down in it.  Knowing what your home is worth, you need to know what homes sell for.  You do not have access to that.  You do not have access to the Multiple Listing Service.  You do not have access through the County Recorder’s office; it does not tell you what homes sell for so what is your home worth is critical to know how much you can list it for.  

Patrick Wiscombe:  If someone makes an offer on your house, you could sell it for a lot less than what you could sell it for.

Patrick Wiscombe:  It&#039;s the Utah Real Estate (http://patrickwiscombe.com/category/utah-real-estate-podcast/) podcast, my name is Patrick Wiscombe.  Coming up on today&#039;s edition of the Utah Real Estate podcast, yesterday we started talking about foreclosures and short sales.  We also talked about started out with a pre-approval.  We talked about finding a specialist and learning about short sale lingo and for heavens sake, don&#039;t rush into buying a house.  That&#039;s where we left off yesterday.  Gregg Hales who is the commercial real estate manager with Weichert Realtor at the Rockies in American Fork Utah joins me for the podcast.  Greg let&#039;s just pick up where we were yesterday.  I know one of the things we were going to talk about is being realistic.  What do you mean by being realistic?

Greg Hales:  Well I think the understanding is every time somebody hears the term short sale, REO, or foreclosure, they think it&#039;s a rock bottom deal.  Sometimes it is not.  The price is the bank has to get out may not be at market value at that particular time.  Do your home work.  Find the prices that are comparable  and purchase it accordingly.  

Patrick Wiscombe:  When buying a house, you may be getting into an area you simply know nothing about.   Again, let&#039;s reemphasize that you should use a professional

Greg Hales:  If I told you Patrick here&#039;s $200,000, please go invest that for me.  You would probably meet with financial planners, money managers, different funds, in order to research and find the best place to get a return on your money.  People will buy a home for $200,000 and ask their neighbor for what it&#039;s worth and pay it.  They don&#039;t understand using a professional allow you to buy the home at the right price at the right time and the right home for you.  

Patrick Wiscombe:  and I guess I could simply restate what you&#039;re saying, get a professional, don&#039;t get hosed.

Patrick Wiscombe:  Greg, let&#039;s get right into this.  What do people need to do to get their house ready and presentable for those who want to buy it?

Greg Hales:  The first and most obvious is to hire a professional.  Realtors see homes every day, they sell them everyday, they see the things that will help sell your home and then ask their opinion and listen to their opinion.  As you prepare to move those things or change things in your home to make it sell-able, they&#039;re an invaluable tool to use.

Greg Hales:  I think the first thing you need to understand is that a buyer is buying your house.  They&#039;re not buying your home.  You&#039;ve made it your home by your knick knacks, your decorations, those things that are personal to you.  I know this may sound difficult to you at times, but some of those things need to be removed.  The things that hang all over your refrigerator, the knick knacks on the wall, those things that have made it your home and your personal home, the things that the buyer isn&#039;t attached to.  They&#039;re trying to buy your house and they will make it their home.  The other thing is that to make is sell-able, look at it from an outsiders eye.  Are things neat and tidy?  Are the corners uncluttered?</itunes:summary>

Roger:  One of the things is just staying in touch with current market conditions.  You know, people pay attention to what the market is doing on a sporadic basis and you may have heard some information three months ago and maybe that was credible information and maybe it wasn&#039;t at that time and you think you know what the market is doing.  The real estate market is like everything else it&#039;s pretty volatile and you need to have your finger on the pulse as to what&#039;s going on today. Recently, real estate is ticking up and we are listing homes in the office now and they&#039;re under contract within a week and prices where we had to be a little bit aggressive before as far as getting the seller to see that he had to be reasonable about his price or he wasn&#039;t going to sell his house. You know, sellers now are getting full price offers and a little bit above price offers and that&#039;s new just within the last week or two.

Patrick:  I think the perception out there is that offers on homes are not going for the full listing price, whereas I think people&#039;s mindset is I can ask whatever I can get for it now.
